Training: Appropriate certification and licensure need to be evidenced before staff are allowed to work in any facility. The same requirement is in place for all agency staffing.

Audit: Periodically perform internal and external audits of the presence of evidence of current licensure for all staff who work in roles for which licensure or registrations are required.All staff should also be checked against the OIG exclusion list.

Attorney General Barbara D. Underwood announced the arrest and arraignment of a Rochester woman, 37, who is charged with grand larceny and unauthorized practice of a profession for allegations that she fraudulently took over$20,000 in payment from a Rochester nurse staffing agency while practicing without a nursing license. The felony complaint alleges that the woman, who was previously registered as a licensed practical nurse, continued to work at a local nursing home even though her professional license was suspended.
